Clearing the air around Aadhaar status

Post the September 26, 2018 Supreme Court verdict relating to authentication of Aadhaar, there has been a lot of confusion with respect to services where Aadhaar is necessary and where not.
Aadhaar is no longer mandatory for services such as bank account, telecom services, and school admissions/entrance tests.
However, it is still necessary for getting a PAN, filing I-T returns, and availing welfare schemes.

Since carrying a physical copy of Aadhaar isn't always practical, the UIDAI launched the mAadhaar app.

mAadhaar is the official Aadhaar smartphone app launched by the UIDAI, to let users easily and conveniently access their Aadhaar details right from their smartphone, whenever and wherever they wish to.

Here's how you can add profiles of your family members in the mAadhaar app.

Clearing the air around Aadhaar status
Post the September 26, 2018 SC verdict relating to authentication of Aadhaar, there has been quite a lot of confusion with respect to services where Aadhaar is necessary.

Aadhaar is no longer mandatory for services such as bank account, telecom services, and school admissions/entrance tests.

However, it is still necessary for getting a PAN, filing I-T returns, and availing government welfare schemes.

Lately, there has been a lot of confusion about the status of Aadhaar card as a valid document proof.

This comes as a result of the constant debate around the authenticity of Aadhaar, and more so, due to the September 26 Supreme Court verdict on Aadhaar.

Here, we clear all the doubts by answering the most frequently asked questions around Aadhaar.

Can UIDAI track my activities?

UIDAI keeps only the basic information of the users, viz. name, address, gender, DoB, mobile number, Email ID, finger prints, iris scans, and facial photograph.

However, it does not keep the following in its database: information of sensitive nature such as bank account details, shares, mutual funds, financial and property details, health records, family, caste, religion, education etc.

Will UIDAI receive my bank/shares/MF details upon linking with Aadhaar?

When you link your Aadhaar with your bank account, shares, or Mutual Fund account, these organizations only send your name, biometrics, Aadhaar credentials, etc. to the UIDAI, and not your bank/MF/share details.

What was the latest Supreme Court verdict on Aadhaar?

On September 26, 2018, a five-judge Supreme Court bench, headed by the then CJI Dipak Misra, struck down some provisions relating to authentication of the Aadhaar program, and the Section 57 of Aadhaar Act.

This disarmed private entities like banks, telecom operators, and e-wallet service providers from asking you to furnish your Aadhaar information in order to avail their services.

After the SC judgement, is Aadhaar still mandatory?

Aadhaar is still mandatory for the following services:

PAN: The linkage of PAN and Aadhaar continues to be mandatory, under Section 139AA of the Income Tax Act.

I-T Returns: Since Aadhaar-PAN linking is still mandatory, one will need their Aadhaar card at the time of filing of Income Tax returns.

Welfare schemes: Aadhaar is also mandatory for availing various government-run welfare schemes and for grant of subsidies.

What services is Aadhaar no longer mandatory for?

Aadhaar is no longer mandatory for these services:

Bank account: After the SC verdict, one does not need to link Aadhaar with their new/existing bank accounts.

Mobile connection: After the scrapping of Section 57 of the Aadhaar Act, private companies like telecom operators can no longer ask users to link their Aadhaar with SIM cards.

Schools/Exams: Aadhaar is no longer mandatory to register for tests like NEET, UGC and CBSE Board exams.

Is e-Aadhaar equally valid as the Aadhaar card?

According to the UIDAI, eAadhaar, ie. the electronically downloaded Aadhaar is an equally valid document as the original Aadhaar issued by UIDAI.

Both these documents are accepted by all concerned agencies.

If any organization or agency refuses to accept eAadhaar as a valid document, a complaint can be lodged in this regard with the higher authorities at the concerned department/agency.

Has there ever been a case of Aadhaar data-breach?

As per the UIDAI, all stories around Aadhaar data breach are cases of misreporting. The Aadhaar-issuing agency claims that Aadhaar data has never been breached, and that they use advanced security technologies to keep your data safe.

Ever since Aadhaar was introduced by UIDAI and Govt. of India, one of the basic premises was that it cannot be canceled.

Once an Aadhaar user has entered the system, he or she couldn’t leave that – only deactivation was possible. But now, as per fresh reports coming in, this may change soon.

Govt. will now soon allow Aadhaar users to ‘opt out’ from the system, and even delete all biometric data and other information. How was this made possible? Keep reading to find out..

Cancel Your Aadhaar - Govt. Will Soon Allow Aadhaar Users To ‘Opt Out’, Delete Biometric Data

Aadhaar Data Opt Out: How?

Based on feedback from security analysts and the public at large, Govt. had proposed to UIDAI and Law Ministry that children who turn 18 years should be given a choice: Whether they want Aadhaar or not.

As per the initial proposal, as soon as someone turned 18, he or she should be given 6 months to decide whether Aadhaar should be kept or not.

However, Law Ministry suggested that this choice to opt out should be provided to all citizens.

A senior official said: “The Ministry further recommended that the option to withdraw be made available to all citizens, and not be limited to a particular group,”

Opt Out Of Aadhaar If You Don’t Have PAN Card

Now, this proposal took another turn, when the Govt. suggested that the option to opt out from Aadhaar should be given to those, who have no PAN Card.

The proposal is now being studied by the Cabinet, and a notification would be issued soon: Whether everyone should be allowed to opt out from Aadhaar or only those who don’t have a PAN Card.

How To Delete Aadhaar Biometric Data?

The proposal also covers biometric and other data which resides with the UIDAI of Aadhaar holders.

If the Cabinet passes the proposal, then users would be able to delete their biometric data as well. This can be a huge boost to the advocates of privacy and data, who were concerned about how Aadhaar works.

In September, the Supreme Court had struck down Section 57 of Aadhaar Act, which prohibited private companies from enforcing Aadhaar data linkage with their services (read telecom operators), and to store any form of biometric data.

This proposal to cancel and opt-out from Aadhaar stems from this Supreme Court judgment and supports the theory that citizens should be able to decide whether they want their data with UIDAI or not.

In nutshell, we support this decision. Do share your views and opinions by commenting right here!

What are the details I have to check when linking my PAN with my Aadhaar card?
When linking your PAN with your Aadhaar card, you have to make sure that your name, date of birth and gender as displayed on the income tax website matches with the details on your Aadhaar card.

Importance of Linking PAN Card with Aadhaar Card
Both the PAN card as well as the Aadhaar card are unique identification cards that serve as proof of identity that are necessary for registration and verification purposes.

The government has urged all entities to link their PAN cards with their Aadhaar cards. This is being done for the following purposes:

Prevent Tax Evasion:

By linking the Aadhaar and PAN cards, the government will be able to keep tabs on the taxable transactions of a particular individual or entity, whose identity and address will be verified by his Aadhaar card. This will effectively mean that every taxable transaction or activity will be recorded by the government.

As a result, the government will already have a detailed record of all the financial transactions that would attract tax for each entity, making tax evasion a thing of the past.

Multiple PAN Cards:

Another reason for linking PAN with Aadhaar is to reduce the occurrence of individuals or entities applying for multiple PAN cards in an effort to defraud the government and avoid paying taxes.

By applying for more than one PAN card, an entity can use one of the cards for a certain set of financial transactions and pay taxes applicable for those. Meanwhile, the other PAN card can be used for accounts or transactions that the entity wishes to conceal from the Income Tax department, thereby avoiding paying tax on them.

By linking the PAN and Aadhaar card, the government will be able to link the identity of an entity through his/her Aadhaar card, and subsequently have details of all financial transactions made through the linked PAN card. If there are multiple PAN cards registered under the same name, the government will be able to identify the same and take corrective action.

Ease in Filing of Income Tax Returns:

Entities who have linked their PAN and Aadhaar cards will be able to file their e-Returns, or their online Income Tax returns seamlessly and quickly. By linking the two, entities will no longer have to submit their Income Tax acknowledgement to the IT department, thus saving tax payers a lot of trouble.

Hi Friends i Think this is tha beast way linking the PAN and Aadhaar card If You Know Moor Added blow in comments

Yesterday, social media rumors began circulating that 50 crore or almost 50% of all mobile connections in India are at risk, due to Aadhaar KYC.

Several mainstream media shared this news, because it had a logic behind it – Supreme Court has ordered all telecom operators and private companies to delete Aadhaar data of users.

Now, once Aadhaar data is deleted, then the telcom operator won’t have any KYC of the user, and this means disconnection.
Govt. has assured no SIM will be disconnected due to Aadhaar
Govt. has assured no SIM will be disconnected due to Aadhaar
Panic began to set in, as mobile users all across the nation began to question the future.

After the outcry, both DoT and UIDAI had to come out, and issue clarifications.

Besides, leading telecom lobby COAI also stepped in, and said that due to the change in KYC model, services won’t be disruppted. However, for that, an alternative KYC needs to be shared.

Govt. of India: No Mobile Will Be Disconnected Due To KYC Issue

Crores of new mobile connections have been issued, solely based on Aadhaar KYC, and if the telecom companies are required to delete this Aadhaar data, then some inconvenience will happen.

However, Govt. of India has assured that no mobile connection will be disconnected.

A senior DoT official said, “We will ensure that customers services are not affected. Whatever arrangements are put in place it will facilitate a smooth transition from the current regime to the Supreme Court-compliant regime.”

At the same time, Govt. has admitted that 25-30 crore mobile users can face some inconvenience, as a new round of KYC will have to be done. This means submitting new documents as verification, other than Aadhaar.

Alternative KYC At The Time Of Issuing New SIM

On Wednesday and Thursday, representatives of the telecom industry, and the Department of Telecom held meetings to chalk out alternatives of Aadhaar-KYC while issuing new SIM cards.

A proposal has been mooted, wherein a new app will be created, for SIM sellers.

At the time of issuing new SIM, this app will embed the customer enrollment form, along with time-stamped, and a geo-tagged photograph of the customer, along with any identity proof such as PAN Card, Voter ID Card, Passport etc.

Although Aadhaar is a valid ID proof, the ise of Aadhaar as KYC will be avoided, as well as storage of Aadhaar data will be avoided, as per Supreme Court ruling.

More details are awaited on this regard.

COAI: Aadhaar Can Be Deleted With Alternative KYC

Meanwhile telecom players’ lobby COAI has assured that Aadhaar details linked with any user can be deleted, by providing an alternative KYC.

COAI Director General Rajan S Mathews said, “Telecom players had a meeting with the Department of Telecom and they have been clarified that customers willing to get their Aadhaar details deleted from telecom operator data base should be allowed to do so against valid identity and address proof,”

COAI has also assured that during the transition from Aadhaar to non-Aadhaar KYC, no mobile number will be disconnected, and services won’t be hampered.

Now, it would be interesting to observe how a smooth transition takes place, and how soon can it be done.

We will keep you updated, as more details come in.

Almost 50% of India’s current telecom users are staring at an impossible reality: Their SIM connections can be disconnected if they have obtained their connection via Aadhaar-KYC mode.

This sounds ridiculous, but this can become the reality.

Aadhaar-Only KYC Mode = Mobile Disconnection
Remember the days when telecom companies were luring, forcing, coercing you to link Aadhaar with your mobile, and get a new SIM by only using Aadhaar?

And you trusted them, and gave your Aadhaar number for getting a new SIM, and doing a new KYC for your existing mobile?

Well, it seems that it was a mistake.

Now, as per fresh reports coming in, all those SIMs which were activated with only Aadhaar as KYC can be disconnected.

The numbers can be as high as 50 crore mobile users, or almost 50% of current telecom users in India!
Aadhaar KYC SIMs can be disconnected
Aadhaar KYC SIMs can be disconnected

Why Aadhaar-KYC Mobiles Are At Risk?

There are two reasons.

First, the recent Supreme Court ruling, which ordered all private companies to destroy Aadhaar related data of customers. Now, UIDAI has asked to delink Aadhaar of users based on this ruling, and an ‘exit plan’ has been sought.

In case telecom firms do delink the Aadhaar, then there will be no KYC left.

And as per Telecom Ministry’s regulations, this means disconnection, unless other KYC is used.

And the second reason is that, in the month of March, telecom companies were ordered to destroy all pre-Aadhaar KYC documents, as they were undergoing digitalized, Aadhaar KYC.

Now, as those KYC documents are destroyed, and the current digitalized Aadhaar is delinked, there is no KYC left.

And this means disconnection.

What Is The Solution Here?

The only solution seems is a new KYC, which would be without Aadhaar.

And this massive exercise means more headache for the users, and telecom operators, as a new round of awareness, execution and follow-up is required.

This time without Aadhaar.

Telecom secretary Aruna Sundararajan has met representatives of various telecom operators, and have discussed this complex issue.

She assured that whatever happens, the subscribers won’t be hassled.

She said, “We want to ensure that it is a smooth transition with little problems for subscribers.”

Non-Aadhaar KYC can be: passport, driving licence, voter’s card, electricity bill, gas bill, PAN card.

Telecom operators have said that Aadhaar number was never mandatory for new mobile connections but used only for the re-verification process of old subscribers, as per Department of Telecommunications norms, which still stand. Telcos added the recent reports quoting Telecom Secretary Aruna Sundararajan saying companies can also accept other modes of identification proofs besides Aadhaar for issuing new connections has led to more confusion for them. “We never told our new customers that Aadhaar was mandatory. So, now we do not know if the secretary means for verifying new customers or re-verifying old ones.
Aadhaar for New SIM Cards Was Never a Must Claim Telcos
This has definitely led to confusion…,” said an official at one of the operators told Economic Times. A DoT official also confirmed the same saying that Aadhaar was never mandatory but was one of the documents that consumers had to give for new connections. It was back in 2016 that telecom department told operators to accept Aadhaar as one of the documents to register new customers. The confusion arose after media reports that Sundararajan said companies had been directed to issue new SIM cards without Aadhaar on the basis of alternative identification such as election voter ID or driving license. “As per rule, fresh connections can be given using any authentic ID and address proof. There is no change in that rule.
Telecom operators cannot deny fresh SIM to people having valid ID and address proof document. For re-verification, we have to wait for Supreme Court order as the matter is sub-judice,” Sundararajan had said. Officials at the telcos asking not to be named say they have no new instructions from the government on the matter. They clarified Aadhaar was a preferred mode of verification for new users as it made the process easier and faster, but it wasn’t the only mode as other IDs including driving licenses and passports are also accepted.
However, an official told that SIM-Aadhaar linking policy still stands and those who have issued SIMs on the basis of other IDs than Aadhaar will be required to undergo re-verification through Aadhaar based e-KYC at later point. With the issue of Aadhaar being debated in the Supreme Court, there have been a lot of confusion, especially since Supreme Court clarified they had never passed any rule for making Aadhaar mandatory. Also, the DoT earlier extended the deadline for re-verification of mobile numbers through Aadhaar till the apex court decides of the constitutional validity of Aadhaar law.

OTP Based Aadhaar-Mobile Linking Process Will Go Live From 1st January
Since last weeks, Govt has been announcing new OTP based Aadhaar re-verification process for telecom users; but due to logistics and technical issues arising from the telecom operator’s end, the process couldn’t be started.
But now, the decks are cleared. All telecom operators have informed the Govt. that they are now ready with the infrastructure for linking mobile number of users with Aadhaar, and starting January 1st, any mobile user would be able to link their Aadhaar with their SIM, using a single OTP. Hence, no more mandatory visits to the retail outlets of telecom companies for performing this task, and no more hassles. However, considering that February 26th is the last date for this process, will Indian citizens have enough enough time to link their mobile with Aadhaar? And, why has this delay happened? We will soon find out..
OTP Based Aadhaar-Mobile Linking: How It Works? The process is very simple, and we must appreciate the telecom operators and UIDAI for making this process really easy. This is how it will work:
-Step 1: Telecom users will be required to call a number, which will be heavily advertized by all telecom operators, all across the India. It seems that different telecom operators will have different toll-free numbers where their users can call and start the process of Aadhaar re-verification. But earlier, UIDAI had informed that there will be a single number for the process. We will update this section when we get more clarity.
-Step 2: The toll-free number shall be an Interactive Voice Response System (IVRS), where the user will be informed about the process in English, Hindi and other major regional languages.
-Step 3: The IVRS will ask for a consent from the user, and when YES would be pressed, the user will receive an OTP. -
Step 4:
As soon as the OTP is confirmed, the mobile number shall be linked with Aadhaar, and the re-verification process would be successfully completed.

But.. Why This Delay? This easy, smooth OTP based Aadhaar re-verification was announced by Govt. in the month of October, when it was said that starting November 15th, users would be able to use this. However, later it was postponed to December 1st, and now, January 1st is the final roll-out date. This unnecessary delay of 1.5 months is something which is really interesting, considering that both telecom operators and Govt. were on the same page on this issue. And, the blame game has already started. COAI, which is an influential lobby of telecom operators have blamed UIDAI for the delay, but UIDAI has refused to accept the blame. It seems there was some confusion regarding the Customer Acquisition Form (CAF), which was earlier supposed to be filled by the user before OTP based re-verification process started. But now, there is no mention of this step.
COAI in a statement said, “This (announcement of November 15th launch) was done even though the telecom department, UIDAI and the (telecom) industry were still under discussions on the OTP-based process… the telecom companies have in the past represented to UIDAI that in order to implement the OTP-based process, the present Customer Acquisition Form (CAF) would be required to be modified.” One of the UIDAI official has claimed that “it was rather the mobile companies that had been dilly-dallying”. Now, the question is, whether 1 month and 25 days are enough for almost 30 crore users who have still not linked their Aadhaar with mobile number? We will soon find out!
Before We End, A Word Of Caution OTP based scams are happening a lot these days, as the scamster leaves no stone unturned to confuse and cajole the end-user to share their OTP. Hence, for OTP based Aadhaar re-verification, only rely on the official number shared by your telecom operator, and NEVER, under any circumstances, reveal your OTP to any person. This OTP based process is fully automatic, and there shall be living person involved.

Final Deadline! Every Mobile No. Should Be Linked With Aadhaar By 26 Feb 2018!
The decks are cleared, and the path is determined. Govt. is refusing to retreat on their firm resolve to make Aadhaar the de-facto identity of every Indian.

In a latest affidavit filed by the Centre, it has been said that every mobile needs to be linked with Aadhaar by February 26th, and every bank with Aadhaar by March 31st.

And, when it comes to hacking of Aadhaar data, then Govt. has plainly stated that no such incident has ever happened.

So, the Aadhaar push is real, and mandatory. There is no way out now.

Mobile No.-Aadhaar Linkage By February 26th: Govt.
In the ongoing case in Supreme Court regarding Aadhaar and its mandatory linkage with services, Govt. of India has filed an affidavit, which states that they cannot go back now.

February 26th is the deadline for every mobile phone user to link their Aadhaar.

The 113- page affidavit was filed by advocate Zoheb Hossain, on behalf of Govt. of India.

On October 31st, in the same case, Supreme Court had questioned Centre’s relentless push towards Aadhaar linkage, and had asked them why it was needed in the first place.

In an indirect reference to this question, Govt. has informed Supreme Court that they are acting on the instruction of the Apex Court itself, and going back on this may not be possible now. Centre is referring to the Lokniti Foundation case, during which arguments were put forth regarding illegal usage of mobile phones, and how Aadhaar can check these activities.

The hearing took place in February this year, and Centre has sought 1-year deadline for implementing the mandatory Aadhaar-Mobile linking, which Supreme Court had approved.

Hence, as per the Centre, going back on this action would be going against the Supreme Court itself.

Bank-Aadhaar Linkage By March 31
Meanwhile, in the affidavit, Govt. has informed Supreme Court that the deadline for linking bank accounts with Aadhaar has been extended till March 31st. Earlier, the deadline was December 31st.

Centre said,
“Until March 31, existing bank accounts will not be made non-operational for not linking with Aadhaar. But as far as opening new bank accounts are concerned, Aadhaar or enrolment ID must be given as proof of identity. For existing account holders, the deadline for Aadhaar based verification is being extended to March 31 and no coercive action will be taken till then.”
Reacting to reports that some Indian citizens have died of starvation, as they didn’t get the approved ration in the absence of Aadhaar, Govt. said no starvation death has been reported as of now.

Besides, Govt. has also denied any incident of Aadhaar data breach or compromising security of the UIDAI server, ever.

Govt. said,
“There has not been a single instance of hacking or data breach in or from UIDAI or any of its servers.”
Besides, the affidavit says that hacking incidents do happen, with or without Aadhaar.

We have already reported that 75% of active SIM cards in India can be deactivated, if Aadhaar is not linked.

Every telco in India is right now ‘ordering’ and ‘requesting’ their users to connect their Aadhaar with their mobile, as soon as possible.
