RBI Clarifies: Linking Bank Accounts With Aadhaar NOT Mandatory As Of Now!
The doubts have been finally cleared. Reserve Bank of India, India’s central banking institution, has made it absolutely clear that linking bank accounts with Aadhaar is not mandatory as of now.
This clarification by RBI has cleared so many doubts, especially at a time when banks are using every force available with them to ‘force’ and ‘coerce’ their customers to link Aadhaar with their bank accounts.
In a related news, Unique Identification Authority of India (UIDAI), the central authority to monitor and regulate Aadhaar cards have explicitly said that no Indian can be denied welfare schemes, in the absence of Aadhaar card.

This comes after a 11-year old kid in Jharkhand died because she was not able to receive ration due to non-availability of Aadhaar.

RBI: Linking Of Bank Accounts With Aadhaar Not Mandatory
Moneylife, a news portal, had filed an RTI with RBI, seeking clarification on the linking with bank accounts.

In their reply, RBI has stated that it “has not issued any instruction so far regarding mandatory linking of Aadhaar number with bank accounts.”

Clearing all doubts related with ‘mandatory’ rule, RBI has said,
“The Government has issued a Gazette Notification GSR 538(E) dated 1 June 2017 regarding Prevention of Money laundering (Maintenance of Records) Second Amendment Rules, 2017, inter-alia, making furnishing of Aadhaar (for those individuals who are eligible to be enrolled for Aadhaar) and permanent number (PAN) mandatory for opening a bank account. It may be noted that Reserve Bank has not yet issued an instruction in this regard”.
This means that Govt. is forcing all banks to ask their customers for linking their bank accounts, in their own capacity. RBI as such hasn’t issued any notification regarding the same.

In the RTI, it was also asked whether RBI has taken permission to force mandatory linking with bank accounts, which, RBI has denied, as they have said they have issued no such notification in their official capacity.

In May this year, we had reported how a journalist figured out that Aadhaar linking of bank accounts is not mandatory, as unnamed bank managers informed her this fact.

However, in June, under Prevention of Money Laundering Rule, Govt. has made it mandatory for all bank accounts to be linked with Aadhaar by December 2017, or else their accounts would be blocked.

Confusion persists, but one thing is clear: If you are linking your bank account with Aadhaar, then do please do it only at the bank, not via phone. If you are doing it via phone, responding to a fraudster, your money can be robbed.

UIDAI: No Indian Can Be Denied Welfare In Absence of Aadhaar
A huge uproar ensued in India, when a 11-year old girl from Jharkhand’s one of the poorest district died when she was not given ration as her Aadhaar was not linked.

Although clarifications were issued later, that she died because of malaria, and not Aadhaar issue, the anger was clearly there.

UIDAI had to come out, and issue a statement, saying that no Indian can be denied welfare in the absence of Aadhaar.

UIDAI CEO Ajay Bhushan Pandey has said, “Section 7 specifies that till Aadhaar number is prescribed, the benefits should be given through alternate means of identification,”

Pandey also stated that the girl had Aadhaar card, and the reason for her death is indeed unfortunate. A proper enquiry would be done to find out the truth.

He said, “The Jharkhand government has ordered a probe in the matter to find out the facts behind the unfortunate incident. I expect that person responsible for denial of benefits – inspite of Aadhaar card – will be held accountable and necessary action will be taken against such people by the state, so that it acts as a deterrent for future.”

Even as the issue of privacy of citizens is being debated in the Supreme Court right now, Govt. of India is continuing with their effort to expand the usage and relevance of Aadhaar in more sectors.

Two major developments have evolved in this regard: Aadhaar number would be mandatory for registration of any property which is being sold in India; and Aadhaar would be mandatorily required for issuing driving license.

Aadhaar Must For Property Deals – Benami No More?
When it comes to real estate, then black money is a major issue. Property prices gets elevated, simply on the basis of rumors, and most of the transactions happen via cash.
In order to put a check on such benami deals, Govt. has now made it mandatory to include Aadhaar during the registration of the documents, related to the property deal.
Hence, for critical documents such as agreement for sale, power of attorney, will and more, participating parties will be required to product and mention their Aadhaar number by law.

In fact, Govt. will soon amend Sections 32 and 32A of the Registration Act, 1908, so that there are no legal loopholes.

An unnamed source who is close to the development said, “Every person presenting a document at the property registration office for registration, shall, whether executing or claiming under the same, undergo Aadhaar authentication..”
Right now, till the it becomes a law, Department of Land Resources, which falls under under the Ministry of Rural Development, has already written to all State Governments and UTs to mandate ‘consent based Aadhaar authentication’ for all property deals.
Once every PAN Card is linked with Aadhaar, then such moves will deter black money hoarders from skipping tax, and real estate market can become more transparent, and honest.

Aadhaar Must For Driving License As Well
In a related news, Government is now about to create a central database of all vehicles and their owners, using Aadhaar as the binding factor.

As per Union Transport Minister Nitin Gadkari, this move will help to stop all ‘bogus licences’, which are issued.

He said, “It will bring transparency and will save people from having licences in different states..”

Earlier this week, Union Minister for Information & Technology, Ravi Shankar Prasad had also hinted that every driving license will be now required to be linked with Aadhaar database.

Your PAN Card Can Be Blocked If Not Linked With AadhaarAs the last date for filing Income Tax returns have been extended to August 5th, several interesting data, revelations and warnings have come out from the Govt., related to Aadhaar card linking with PAN Card.

But first, let us start with the facts.

1.2 Million PAN Cards Deactivated Due To Duplication
In a written reply to a question in Lok Sabha, Minister of State for Finance Santosh Kumar Gangwar informed that due to duplication issues, 11.44 lakh PAN Cards have been deactivated.
He explicitly stated that every Indian citizen is entitled to have only one PAN Card. Around 1500+ cases of fake PAN Cards were also unearthed, which were issued to non-existing citizens.
He said, “One PAN for one person is the guiding principle for allotment of PAN..”

PAN Card May Be Blocked After August 31st If Not Linked With Aadhaar
When Central Board of Direct Taxes (CBDT) issued a statement regarding extension of the last date of filing IT returns to August 31st, they said that PAN Cards which are not linked with Aadhaar before August 31st can be blocked.

While the last date for filing ITR has been extended till August 5th from August 1st; the last date for linking PAN Card with Aadhaar has been declared as August 31st.

The statement said that if Aadhaar card is not received, then mentioning acknowledgement number is enough.

The statement said, “For the purpose of e—filing return, it would be sufficient as of now to quote Aadhaar or acknowledgement number for having applied for Aadhaar in the e-filing website.”, adding, “The actual linking of PAN with Aadhaar can be done subsequently, but any time before August 31, 2017,”

The date for ITR filing has been extended due to issues related with website access.
The statement said, “While technical snags have been removed already, the main reason for failure of people to log in (the e-filing portal) is because of last minute rush and panic in which those who have already logged in want to continue for the entire period for fear of losing it.”
Thus, this is clear that even if you are not filing ITR, linking your PAN Card with Aadhaar is a necessity now.

Some earlier reports state that PAN Cards can be linked with Aadhaar till December 31st, after which they would be blocked.

Govt. of India: Aadhaar Cannot Be Used To Track Anyone
Meanwhile, in the ongoing case related to protection of privacy and Aadhaar execution, Govt. informed the Supreme Court that Aadhaar cannot be used to track any person.

Additional Solicitor General (ASG) Tushar Mehta, who was representing Unique Identification Authority of India (UIDAI) said that such are the inbuilt privacy protection features within Aadhaar system, that even UIDAI ‘wouldn’t know where the Aadhaar is being used.’

The case is sub-judice, and is being currently debated and heard by a nine-judge constitutional bench led by the Chief Justice of India JS Khehar.

Aadhaar Confusion Cleared! Govt. Says Aadhaar Not Compulsory For Death Certificate, Railway TicketsAs the privacy issue concerning Aadhaar Card is being heard in the Supreme Court, Govt. yesterday cleared several misconceptions related to the usage and implementation of Aadhaar cards.
Clearing confusion, Govt. has clarified that Aadhaar is needed for death certificates, but it is not mandatory as of now.
Besides, Govt. has also cleared that as of now, Aadhaar is not compulsory for issuing railway tickets.

Were these statements issued just because the privacy factor is being heard in the apex court? Or does the Govt. want to water-down the after-effects of Aadhaar in our daily lives and death?

Aadhaar Needed For Death Certificate, But Not Mandatory
Yesterday, a sort of confusion hit the masses when the Registrar General India (RGI) issued a statement regarding Aadhaar for getting death certificates. As per the statement, if anyone wants to issue death certificate after October 1st, then Aadhaar is a must.

This is what the statement said: “An Applicant applying for death certificate is required to provide Aadhaar number or Enrolment ID Number (EID) of the deceased and other details as sought in the application for death certificate for the purpose of establishing the identity of the deceased..”

The statement also said, “The Aadhaar number will be required for the purpose of establishing the identity of the deceased for the purpose of death registration with effect from October 1,”

People started questioning the logic of this statement, as some thought that Govt. is trying too hard to push Aadhaar – not even in our present lives, but even after that.

Some questioned that what if the deceased person had no Aadhaar? Will his/her death be invalid?

Later, clearing the confusion, Govt. issued a statement saying that Aadhaar is needed, but is not compulsory. In case Aadhaar is not available, then the dependents of that person can issue a statement saying, ‘deceased person did not possess Aadhaar number to the best of their knowledge.’

However, giving false or incorrect information is still a crime, when it comes to Aadhaar.

The statement said, “Any false declaration given by the applicant in this regard will be treated as an offence as per the provisions of the Aadhaar Act, 2016 and also Registration of Birth and Death Act, 1969,”

Interestingly, an unnamed, cold war was brewing between RGI and UIDAI, on the issue of Aadhaar for birth and death certificates. The recent confusion related to Aadhaar for death certificates is a proof of this cold war.

Aadhaar Not Mandatory For Railway Tickets
Meanwhile, replying to a question in Rajya Sabha, Union Minister of State for Railways Rajen Gohain has clarified that as of now, Aadhaar is not mandatory for issuing railway tickets.

However, he said that in order to avail senior citizen concession, Aadhaar is required on a voluntary basis, effective January 1, 2017.
He said, “At present, there is no proposal to make the Aadhaar number compulsory for booking tickets for rail journey. However, with effect from January 1, 2017, the requirement of Aadhaar verification for getting concessional railway tickets for senior citizens has been introduced on a voluntary basis,”
This clears several doubts related to Aadhaar and Railway Tickets, as rumors were floating that Govt. may soon make Aadhaar a mandatory requirement for issuing railway tickets.

Govt. Admits That 210 Websites Are Publicly Displaying Aadhaar Data!Right now, a 9-judge bench inside Supreme Court is debating whether privacy is a fundamental right of Indian citizens or now. And the verdict of this case shall be a water-shed moment for India’s massive biometric powered citizen identity program: Aadhaar.
However, even as the debate regarding privacy and Aadhaar is on, two very interesting developments have happened, which needs a closer scrutiny by advocates of privacy, and campaigners of Aadhaar based database.
Should be say good-bye to the privacy aspect of Indian citizens? Is your Aadhaar data protected?

While Govt. has admitted that around 200 websites are still displaying Aadhaar data of Indian citizens, UIDAI CEO has said in an interview that even if Aadhaar number is leaked, it is not a big deal.

210 Websites Displaying Aadhaar Details Of Citizens
In a written response to a question inside Parliament, PP Chaudhary, who is the Minister of state for electronics and IT admitted that 210 websites are still displaying Aadhaar details of Indian citizens, which can be accessed by anyone.

However, he said that there has been no leakage of Aadhaar data by UIDAI, which is the apex body managing Aadhaar expansion and execution.

As per the reply, majority of the websites which are displaying Aadhaar details are Govt. websites, educational portals and NGOs, which are required by law to show who are the beneficiaries of the welfare schemes.

Under RTI, anyone can ask for this information, hence they have publicly showcased the data (which includes Aadhaar data as well) on the websites.
The Minister said, “Some ministries were publishing this data in compliance with the Right to the Information Act which says that list of beneficiaries should be public so that citizens know that where the government money has been spent.”
As per IT minister Ravi Shankar Prasad, 530 social welfare schemes initiated from 63 ministries and 1,200 schemes from 75 ministries are directly linked with Aadhaar.

As per the reply, UIDAI has now been instructed to remove the Aadhaar details from their websites, and the process is on.

The Minister said, “They were also publishing Aadhaar numbers and bank accounts details but in March we told them not to publish such details and they have complied with it.”

UIDAI CEO: No Need To Worry If Aadhaar Number Is Leaked
Meanwhile, in an interview, UIDAI CEO Ajay Bhushan Pandey has said that there is no need to worry, if Aadhaar number of any citizen is leaked.

As per the CEO, Aadhaar dataset includes biometric details along with demographic data combined with the Aadhaar number. Out of this, if the Aadhaar number is leaked, it should not create chaos.

He said, “What I would like people to understand is that Aadhaar is not a secret number like your password or PIN [personal identification number], which can materially affect your life tomorrow if it is leaked without your knowledge. It is not like your Aadhaar number is leaked and your bank account gets emptied out.”

Along with that, he assured that around 5000 operators have been penalized due to Aadhaar leak, and strict instructions have been provided to ensure that Aadhaar number and other details are not leaked.
He said that they have now ‘banned’ publishing of Aadhaar data on any website, and strict action is being taken against those who are still doing it. However, he also said that no action has been taken against those Govt. agencies which had published Aadhaar data by mistake, because the intent was not ‘criminal’.

To make things easy for the citizens and to give the ‘Digital India’ initiative a little push, the government has launched it’s new mobile based application, mAadhaar. The mobile app has been developed by the UIDAI (Unique Identification Authority of India).

What is mAadhaar, and How does it Work?
UIDAI has launched a new mobile based app interface, which will carry all your basic Aadhaar information (includes all demographic information like name, DoB, gender and registered address with the official photograph) on an electronic based platform. Basically, the mAadhaar is the ‘official soft copy’ for your original Aadhaar. The app will link with your Aadhaar number and you can simply carry your Aadhaar on your device.

Only on Android (Soon on iOS)
The app has been made available on Google Play [link below] and will be for android users for the time being. The app will soon release on iOS as well.

Mobile Number Mandatory
For you to use the mAadhaar app, your mobile number has to be registered with your official Aadhaar. The registered mobile number will link with the mAadhaar app on your device, and the mAadhaar will generate.

No More Hard Copy Required
After you link your registered mobile number is to the mAadhaar app, you will get an option to the download Aadhaar Number profile directly through the device. So, if you have the mAadhaar with you on your device, you don’t have to carry the hard copy of your Aadhaar Card anymore.

Biometric Locking-Unlocking Feature to Secure Personal Data
The unique feature of the app is, that it will allow the users to lock or unlock biometrics data. When any resident enables the Biometric Locking System on the app, the biometric will remain locked until the user or the Aadhaar Holder chooses to either Unlock it (which would be for a certain time period) or Unlock the Biometric System. Plus, the app comes with the Time Based One Time Password (TOTP) feature, which can be used instead of the SMS based OTP.

Retrieve Information Instead of Manual Entry
The users on the mAadhaar app will have the option to get an updated view of their profile if there is any update request or on completion of an update. One can even share the QR code and the password protected eKYC data to retrieve the accurate demographic information from the app instead of any manual entry.

PAN-Aadhaar Link
The Finance Bill for 2017-18 has made it mandatory from July 1 for everyone who has a PAN card, should link their PAN to the Aadhar. The mAadhaar app is currently in the beta stage and will be adding up a number of the features in the future.

To use the mAadhaar app, you need to have your Mobile Number is registered with Aadhaar Card. In case you don’t have your number registered, visit the nearest Aadhaar Enrollment Center to register your mobile number!

Linked your Aadhaar with PAN, here are five steps to do it
There are only two more days left to link your Aadhaar number to your PAN card. If you don't do it before 30 June, in case you do not have Aadhaar and you do not wish to obtain Aadhaar for the time being, then your PAN will not be cancelled so that your consequences under the Income Tax Act for failing to quote PAN may not arise.
Amending income tax rules and notifying the same, the government has made quoting of the 12-digit biometric Aadhaar or the enrolment ID a must at the time of application of permanent account number (PAN).
Finance minister Arun Jaitley through an amendment to tax proposals in the Finance Bill for 2017-18 had made Aadhaar mandatory for filing income tax returns and provided for linking of PAN with Aadhaar to check tax evasion through use of multiple PAN cards.
The revenue department said "every person who has been allotted PAN as on July 1, 2017, and who in accordance with the provisions of sub-section (2) of section 139AA is required to intimate his Aadhaar number, shall intimate his Aadhaar number to the principal director general of income tax (systems) or DGIT (systems)".
Here are five steps you can do it.
Step 1: Keep Aadhaar and PAN numbers handy.
Step 2 : Register on the Income tax e-Filing portal if you already haven’t yet. If you are already registered at the income tax department’s e-Filing portal, log in using your ID, password and date of birth.
Step 3: A pop up window will appear, prompting you to link your PAN card with Aadhaar card. If you have a pop up blocker active, you will have to go on the “Profile Setting” on the dashboard’s menu bar to click on “Link Aadhar” option.
Step 4: You will have to add the necessary details like name your Date of Birth as per the PAN details as well as your gender. If you data is different that what’s mentioned on your PAN, the Aadhaar will not be linked to your PAN.  Next thing to do is, to enter your 12 digit Aadhaar card number, then verify captcha and then click on “Link Aadhaar” button. Once your validation is successful, your Aadhaar will be successfully linked to your PAN.
Step 5: The last step is when a popup message is displayed stating that your Aadhaar card has been successfully linked to your PAN card.
Keep in mind, that once the Aadhaar-PAN linking is done, you can e-Verify your IT returns using Aadhaar. That’s when your mobile is registered with Aadhaar. By linking the two cards you will no longer have to submit your Income Tax acknowledgement to the IT department.

Aadhaar has been made compulsory to file Income-Tax returns or applying for PAN, which also needs to be linked to Aadhaar.

The government has made quoting of biometric identity number Aadhaar mandatory for opening of bank accounts as well as for any financial transaction of Rs 50,000 and above.

Existing bank account holders have been asked to furnish the Aadhaar number issued by the Unique Identification Authority of India by December 31, 2017, failing which the account will cease to be operational.

The government in Budget 2017 has already mandated seeding of Aadhaar number with Permanent Account Number to avoid individuals using multiple PANs to evade taxes.

The notification issued amending the Prevention of Money-laundering (Maintenance of Records) Rules, 2005, mandated quoting of Aadhaar along with PAN or Form 60 by individuals, companies and partnership firms for all financial transactions of Rs 50,000 or above.

Tightening the rules for small accounts, which can be opened without having officially valid KYC documents, the amendment said such accounts — which can have maximum deposit of Rs 50,000, can be opened only at bank branches which have core banking solution.

It can also be opened at a branch where it is possible to manually monitor and ensure that foreign remittance are not credited to such account and stipulated limits on monthly and annual aggregate of transactions and balance are not breached, the amended PMLA rules said.

Such small account shall remain operational initially for a period of 12 months and thereafter for a similar period if the account holder provides evidence that he or she has applied for officially valid identification documents.

“The small account shall be monitored and when there is a suspicion of money laundering or financing of terrorism or other high risk scenarios, the identity of claim shall be established through the production of official valid documents,” it  said. Post-June 1, if a person does not have an Aadhaar number at the time of opening of account, then he has to furnish proof of application of enrolment for Aadhaar and submit the number within six months of opening of the bank account.

Where all you need Aadhaar

inking Aadhaar number with your bank account, last date December 31, 2017; here’s how you can link
Quoting Aadhaar card as a mandatory document, the government has now issued a deadline to link the biometric identity number to bank accounts. It has been notified by the government that the existing bank account holders need to submit Aadhaar details to banks on or before December 31, 2017. If a customer fails to do so, the bank account will become invalid. This means that Aadhaar-less bank accounts will be frozen after December this year.
Most banks have been encouraging account holders to link Aadhaar with their bank accounts through SMS and phone calls. Till now, PAN card was required as a document to open a bank account, or for any transactions above Rs 50,000 but from June 1, the Aadhaar number has been made mandatory for opening a bank account. Moreover, if a person does not have an Aadhaar number at the time of opening of account after 1 June, the individual has to furnish proof of application for enrollment in Aadhaar and submit the number to the bank within six months of opening the account. The government has already made it compulsory to link Aadhaar with PAN to avoid individuals using multiple PANs to evade taxes.

The lowdown on linking of Aadhaar-PAN for taxes
The simple act of paying your income tax to the government — an article of citizens’ faith that is not exercised by enough Indians with incomes over Rs. 2.5 lakh a year if you go by India’s low direct tax base — will never be the same again. Having a PAN (permanent account number) card from the Income Tax department will no longer be enough to file your returns. Starting July 1, the government has made it mandatory for taxpayers to link their Aadhaar number to their PAN cards in order to be able to file returns. Aadhaar numbers have also been made mandatory for all those applying for a new PAN card after July 1.

Among several changes appended to this year’s Finance Bill that did not figure in the budget speech, Finance Minister Arun Jaitley introduced a new Section, 139 AA, in the Income Tax Act of 1961. This new Section stipulates that all PAN cardholders share their Aadhar number with the tax authorities so that the two documents can be linked, and makes quoting of Aadhaar mandatory for all PAN card applications and to file income tax returns. Parliament approved the Bill in April, including the provision that Mr. Jaitley stressed was a measure to check tax evasion by those having multiple PAN cards. The new provision also states that the existing PAN cardholders who fail to link their Aadhaar numbers will have the legal status of their PAN card revoked and those cards will be held invalid for all other purposes. However, petitions were filed in the Supreme Court, challenging the move with the argument that it runs foul of the court’s earlier decision on Aadhaar-related petitions that the unique ID number cannot be made mandatory. The Supreme Court ruled on June 9 that the new provision does not violate the Constitution or its earlier order passed in 2013. For those holding Aadhaar numbers, the court said the provision would apply in totality but held that PAN cards of those who do not have Aadhaar number cannot be held as invalid “for the time being.”

PAN cards are mandatory not just for filing income tax returns, but also for deposits above Rs. 50,000 into bank accounts as well as purchasing property, among other things. The universe of taxpayers in India is smaller than the number of PAN cardholders. Aadhaar was introduced as a unique identification system that would pay off the government’s investment in capturing people’s biometric information by plugging leaks and benefit-cheating in welfare programmes for the poor through real-time authentication of the beneficiary’s identity. Most taxpayers, barring those earning up to Rs. 10 lakh a year who still get cheaper LPG cylinders, are not eligible for subsidies. Effectively, the Centre has managed to expand the ambit of Aadhaar beyond subsidy beneficiaries, thus making it a more universal identification system.

If you don’t have an Aadhaar number yet, you could either fast-track your income tax returns and submit them before July 1 or enrol yourself for Aadhaar. For now, the government has said that even an Aadhaar enrolment number will suffice in order to file returns or apply for a PAN card. Those who already have an Aadhaar number must ensure they quote it in their returns as tax experts warn that any attempt to conceal the same would be tantamount to providing false information and invite prosecution under the income tax law, with punishment that could include imprisonment and fines. The Supreme Court may have offered limited relief to taxpayers, but the bigger battle over the Aadhaar programme will continue in its corridors as and when a Constitutional Bench is formed to examine Aadhaar-related concerns about right to privacy and human dignity as limbs of Article 21 of the Constitution.

Link your land records with Aadhaar, else face action under Benami Act

The union government is mulling linking of all land records from 1950 with Aadhaar numbers of land owners. All states have been asked to complete digitalisation of land records from 1950 of all immovable property. The government is now considering action under the new Benami Transaction (Prohibitions) Amended Act against those who fail to link the digitalised land record with Aadhaar numbers of the owners.

A directive from the Under Secretary to the Government of India dated June 15 asks Chief Secretaries, Additional Chief Secretaries of all States and Union Territories, Lt Governor of Delhi and Secretary of NITI Aayog to ensure digitalisation of all land records from 1950 and linking of the information to property owners' Aadhaar numbers. All documents of land records, mutation records, sale and purchase records from the year 1950 of any immovable property including agricultural land, houses before August 14 this year. The directive also says that the government is mulling initiating action against those who fail to link their land records with Aadhar number. The letter also seeks suggestions from states on the matter.

Govt may link Aadhaar with property records; to expose benaami owners
Mumbai: Following closely on the heels of linking bank accounts and PAN with Aadhaar, the government is now planning to mandate the linking of Aadhaar with all land records under the Digital India Land Records Modernization Program (DILRMP).

According to a report in India Today, this is a step in the direction of exposing benami properties and making land records transparent.

The quoting of the 12-digit unique identification number will make it easier for authorities to identify owners. It will easily reveal if the owner is a benami owner or not. It will also ensure easier access to bank loan provisions and crop insurance for farmers.

The central government has asked all state governments and Union Territories to digitise "land records, mutation records, sale and purchase records from year 1950- of any immovable property (see section 2 of the Income Tax Act 1961 and subsequently amended) including land (agricultural and non agricultural), houses (independent or Society) etc by 14 August 2017".

After bank accounts, the government of India is planning to link all land records with the owners' 12-digit Aadhaar number under the Digital India Land Records Modernization Program (DILRMP).
Sources, familiar with Centre's plan, said linking of land records and Aadhaar number of the owner is being considered as a valuable step towards exposing benami properties. The government hopes to bring transparency in land records, they said.
Linking of properties with Aadhaar will make it easier for the authorities to identify the owner of the property. Even basic investigation will help the authorities find out whether owner is a benami or real owner of the property.
